Terms of Service

These Terms of Service ("Terms") govern your use of Bellubi, operated by S&C Holding GmbH.

1. Agreement

By creating an account or using Bellubi, you agree to these Terms. If you do not agree, do not use our service.

2. Service Description

Bellubi is a website chatbot service that:

• Reads your website and builds a knowledge base from it
• Answers your visitors' questions using AI, with a link to the source
• Is added to your website with one line of code
• Provides an admin area for knowledge, conversations and statistics

3. Account

3.1 Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account.

3.2 Eligibility

You must be at least 16 years old to use Bellubi.

3.3 Account Security

You are responsible for all activity under your account. Notify us immediately of unauthorized access.

4. Subscription Plans

4.1 Getting Started

New accounts start with a free, non-binding demo (30 days, 50 questions, on a Bellubi demo page). To use Bellubi on your own website, choose a paid subscription plan. See Section 4.2 for current pricing and plan details.

4.2 Paid Plans

Bellubi offers multiple subscription tiers with different features, chat limits, team logins and languages. For current pricing and plan details, visit www.bellubi.com/#preise.

4.3 Billing

• Subscriptions are billed monthly or annually; annual plans are billed in advance for 12 months
• Payments are processed through our payment provider
• Prices exclude applicable VAT

4.4 Cancellation

• Cancel anytime by email to hello@bellubi.com
• Access continues until the end of the billing period
• No refunds for partial months

5. Your Content

5.1 Ownership

You retain ownership of all website content, documents, and data you provide.

5.2 License to Us

You grant us a limited license to read, process, store, and display your content, including the public content of your website, solely to provide the service.

5.3 Your Responsibility

You are responsible for ensuring you have the right to upload content. Do not upload illegal, fraudulent, or harmful content.

6. AI Processing

6.1 Consent

By using Bellubi, you consent to your content and your visitors' questions being processed by AI services (OpenRouter and the model providers it routes to, OpenAI, TypeSafe) to generate answers.

6.2 Accuracy

AI answers are not 100% accurate. Always review the answers and your knowledge base in the admin area.

6.3 No Liability

We are not liable for errors in AI-generated answers. You are responsible for reviewing and correcting the information Bellubi uses.

7. Team Access

7.1 Feature

Certain subscription plans allow additional logins for team members. See www.bellubi.com/#preise for plan details.

7.2 Responsibility

Account owners are responsible for actions taken by their team members.

7.3 Permissions

Team members can view conversations and edit knowledge but cannot delete accounts or change billing.

8. Prohibited Uses

You may not:

• Use the service for illegal purposes
• Upload fraudulent content
• Attempt to circumvent security measures
• Reverse engineer the application
• Resell or redistribute the service
• Use automated systems to abuse the service

9. Intellectual Property

9.1 Our Property

Bellubi, including its design, features, and code, is owned by S&C Holding GmbH.

9.2 Trademarks

"Bellubi" and associated logos are trademarks of S&C Holding GmbH.

10. Disclaimer of Warranties

Bellubi is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted service
• Error-free operation
• Accuracy of AI-generated answers
• Suitability for tax or legal purposes

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months before the claim
• We are not liable for data loss if you have not exported your data

12. Indemnification

You agree to indemnify us against claims arising from:

• Your use of the service
• Your content
• Your violation of these Terms

13. Termination

13.1 By You

You may delete your account at any time by email to hello@bellubi.com.

13.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent activity
• Non-payment
• Extended inactivity (12+ months)

13.3 Effect

Upon termination, your data will be deleted within 30 days.

14. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email.

15. Governing Law

These Terms are governed by Austrian law. Disputes shall be resolved in the courts of Vienna, Austria.

16. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.
